Carpatair cannot be liable for damage to, loss or delay of cargo, if one of the following aspects occurs: cancellation due to weather conditions, weight restrictions, late arriving equipment, shipment that has not been pre-booked through the cargo service center, improper packaging, innacurate weight, dimensions or piece count, security related issues, late tender, incorrect documentation or Air Waybill, incorrect form of payment, Shipper/Consignee or account number.
Extent of Liability
Carpatair as Carrier will be:
Liable for damage to or loss or delay in transportation of cargo on its lines if caused by neglijence of Carpatair or its agents only.
Not liable if the destruction, loss or damage to cargo has resulted solely from the inherent defect, quality, nature or vice of the cargo.
Not liable for damage to or loss or delay of cargo caused by compliance with the law, governmental regulations, Customs requirements, from failure of the Shipper or Consignee to comply therewith or from any cause beyond the Carrier's control.
Liable only for such period during which shipment is in physical possession of Carpatair or its handling agents.
Unlimitedly liable for damage to, loss or delay of cargo caused by willful fault of one of its employees or handling agents or in case of acceptance of a shipment for which no Air Waybill had been issued.
Not liable in all cases when an Air Waybill had been issued for transportation on other than Carpatair's lines, in which case Carpatair is acting as an agent only.
Not liable when acting as a handling agent for other carrier/s unless willful fault is proven.
